Terms and Conditions
Website and enquiry terms.
These terms govern use of this website and all enquiries submitted through it. They do not create a right to purchase or receive any product.
1. Operator details
The website is operated under the trading name Pinnacle Physiques. The operator's final legal name, company number, registered or principal address, VAT number where applicable, and contact email must be inserted here before launch (the “Operator”, “we”, “us” or “our”).
2. Business enquiries only
This website is intended solely for persons acting for a business, laboratory, institution or other professional organisation. It is not directed at consumers or persons seeking products for personal use. By submitting an enquiry, you confirm that you are authorised to act for the organisation identified in it.
3. Testing-purpose restriction
Products are presented only for lawful analytical, laboratory or other testing purposes approved by us. They are not offered for human or animal administration, diagnosis, treatment, prevention, cure, compounding, personal use, or resale for any such purpose. Website information is not medical, pharmaceutical, veterinary, prescribing or dosing advice.
4. No offer, order or contract
Website content is an invitation to enquire only. Adding an item to the enquiry basket or submitting a form does not constitute an offer capable of acceptance, reserve stock, confirm availability, set a final price, or create a contract. A transaction exists only when the parties complete the separate written acceptance process specified by us.
5. Verification and refusal
We may request identity, organisation, intended-use, licence, registration, destination, payment-risk and delivery information. We may reject, suspend or discontinue any enquiry at our discretion where eligibility, lawful supply, intended use, documentation, availability, payment or destination requirements are not satisfactorily established.
6. Your warranties
You warrant that information supplied is accurate and complete; the proposed acquisition, possession, import, storage, handling and use are lawful in every relevant jurisdiction; all necessary approvals and competent personnel are in place; and the products will not be diverted, relabelled or supplied for a prohibited purpose. You must notify us if any relevant fact changes.
7. Product and website information
Images, descriptions, variant information and availability are indicative and may change. A certificate of analysis, laboratory result, safety data sheet or batch document supports the limited matters stated in that document only. It is not a representation of clinical safety, efficacy, regulatory status or fitness for a particular purpose.
8. Separate sale terms
If an enquiry is approved, price, taxes, delivery, risk, title, payment, inspection, rejection, cancellation and returns will be governed by the written quotation, invoice or supply terms issued for that transaction. If those documents conflict with these website terms, the transaction-specific written terms take priority.
9. Intellectual property and acceptable use
Website content, branding and artwork are owned by or licensed to the Operator. You may view the site for legitimate business evaluation but must not copy, scrape, republish, misrepresent, interfere with, or use it for unlawful activity.
10. Availability and external links
We do not promise uninterrupted or error-free access. We may change or withdraw content without notice. Third-party links and documents are provided for convenience and do not constitute endorsement or control of those third parties.
11. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, and to the fullest extent permitted by law, we exclude liability arising from reliance on website content, site unavailability, unauthorised or prohibited use, and indirect or consequential business loss. Any liability connected with an accepted transaction will be governed by its separate written terms.
12. Indemnity
To the extent permitted by law, a business enquirer will be responsible for losses, liabilities, claims and reasonable costs arising from its material breach of these terms, false declarations, unlawful conduct, or use or onward supply contrary to an agreed restriction. This clause must be reviewed by counsel for enforceability and insurance alignment.
13. Privacy
Personal data submitted through the site is handled as described in our Privacy Policy. Do not submit patient information, medical records or other special-category personal data through an enquiry.
14. General
If a provision is unenforceable, the remaining provisions continue. Delay in enforcing a right is not a waiver. No third party may enforce these terms under the Contracts (Rights of Third Parties) Act 1999. We may update these terms for future website use.
15. Governing law
Subject to solicitor confirmation of the Operator's establishment and target market, these terms are intended to be governed by the law of England and Wales, with the courts of England and Wales having exclusive jurisdiction over business disputes.
